PPL Profile Privacy License
Profile Privacy License increases user privacy and takes back personal information from corporations and put it strictly back in the hands of its rightful owners. Further, the PPL aims to severely limit the use of profile information and adopt an active consent model requiring profile owners to be informed ahead of time how their information is being used. Profile owners have a right to allow or deny any and all use of their licensed information at their discretion.
The license holds presumption of innocence and therefore requires, under penalty of law for any and all unspecified damages due to unwarranted information disclosure, none of the licensed information be shared with authorities unless the licensee is legally compelled to do so under an order of a judge or some legal recourse that may be brought upon the company for not disclosing the information. In the case that legal recourse and may be defended against in the court of law, the licensee has an obligation to inform the licensor of the legal implication and give the licensor the opportunity to defend themselves, reimbursing the company for any and all damages caused by taking such a course of actions. The general principle of good faith would apply to this arrangement, meaning that the licensee must try in good faith to fulfill their obligations to this contract to the best of their abilities, responsibilities, and obligations.
Further, the company must make attempts, unless instructed by the law not to do so, to allow the owner of the information to pay the bear the costs of any such defense if he or she chooses to do so on behalf of the company in order to protect their innocence. This essentially means that if the company is compelled to hand over information about a certain user, then the user has the right to ask the company not to disclose the information and rather become legally responsible for defending the company for any legal recourse that the
Preamble
The Profile Privacy License (PPL, pronounced "People") is an explicit license for profile data. It's an integral part of certain specifications that allows data to be exchanged. The purpose of the PPL is to put the rights of private information in the hands of users, rather than large corporations and governments. As a secondary goal PPL increases the public expectation of privacy of any and all publicly identifiable information captured and retained by any organization. Further any organization using such data is obligated to turn over control of any and all personally identifiable information back to the user and if asked, delete any and all references of such information from any and all databases including backups that they maintain.
Profile information or data means any and all personal information about a user including but not limited to name, e-mail address, mailing address, any demographic data, any psychographic data, or any other personally identifiable information, this includes any images that may be used to identify the user. Profile information also includes any information derived from profile information through various methods such as certain statistical analysis, mining social graphs, etc.
Basic Permissions
The PPL allows for any and all legal activities in the strict interests of the licensor to be performed by the licensee using the licensed data provided that the licensee provide a detailed disclosure of those activities and get informed consent from the licensor for using the data in such a way. The disclosure must be made available publicly without any terms or conditions attached to such a disclosure.
The PPL follows a strict disclosure and informed consent framework. Any and all uses of the licensed information must be disclosed to the licensor before the use has commenced. Any action taken, new data being generated, and so on must be clearly be explained in detail to the licensor in language that he or she can understand. The licensor must then agree to allow such actions to be performed with the licensed information by the licensee. Any actions performed without the consent of the licensor are a breech of this contract and immediately revoke any and all rights given to the licensor. The licensee agrees to provide immediate and complete injunctive relief by ceasing any and all activities that have not been consented by the licensee. Further, unspecified damages may be sought by the licensor if he or she deems that harm has been brought through the activities of the licensee.
Storage
Due to the nature of this license, this license strongly recommends that profile such information not be backed up and instead re-requested from its source as needed, thereby creating a single source of such information which is under the full control of the user. This further will ensure that the information remains accurate and the rights of users to their anonymity are protected.
Rights of data owners
Revocation of any previous rights given or implied
In asserting the use of this license users assert their privacy rights in both the legal and philosophical sense. This means such users have a very high expectation of privacy and licensees of such information are required to respect this right to privacy. As such any information that is currently being maintained by the entity about a user is hereby returned to the user with the licensing terms of this agreement. That means that any such information may only be held as long as the user accepts it being held, and must be completely removed from the licensees
